Terms of Service

Terms for using the Boilerlykit website and purchasing digital template licenses.

1. Who We Are

These Terms of Service are a binding agreement between you and Abdelkader settah, a sole trader residing in Algeria, trading as Boilerlykit (referred to as "Boilerlykit", "we", "us").

2. Acceptance of Terms

By accessing or using the Boilerlykit website ("Service") or purchasing any template, boilerplate, or digital product, you agree to be bound by these Terms. If you do not agree, do not use the Service and do not complete a purchase.

3. Description of Service

Boilerlykit sells digital products (source code, templates, and related documentation) as one-time purchases with a perpetual license under the terms shown at checkout. Products are delivered digitally (instant download or repository access) immediately after successful payment. The Service is provided "as is" and "as available".

4. Payments & Merchant of Record

Orders placed on this site are processed by Polar Software, Inc. (3500 South DuPont Highway, Dover, DE 19901, United States), acting as the Merchant of Record and authorised reseller of the products listed here. When you complete a purchase, you enter a sales contract with Polar for the product, and a separate licence with us governing your use of the product under these Terms.

Polar is responsible for payment processing, invoicing, collection and remittance of VAT, GST and applicable sales taxes, refunds, chargebacks, and buyer-facing transactional support. Polar collects and remits VAT in the European Union (via its Irish OSS registration, VAT EU372061545), VAT in the United Kingdom, and sales tax in applicable US states. Buyers in other jurisdictions may be responsible for import duties or local taxes on their purchase.

Buyer-facing payment terms are set out in Polar's Checkout Buyer Terms at https://polar.sh/legal/checkout-buyer-terms. Prices displayed on product pages are shown in the currency selected by Polar at checkout and include applicable taxes where required. Payment card data is collected and processed by Polar and its payment processor. We do not receive or store your full card details.

If you experience technical issues accessing a purchased template, contact us at support@boilerlykit.com and we will use reasonable efforts to help you regain access.

5. Digital Delivery

The templates sold through this site are digital content delivered immediately after successful payment, typically as private GitHub repository collaborator access provisioned automatically by Polar after checkout. At checkout you acknowledge that delivery will begin as soon as payment is confirmed and, where the statutory right of withdrawal applies, you consent to that immediate delivery.

Where you begin downloading, streaming, cloning, using or otherwise benefiting from a template during any statutory withdrawal period, the statutory right to withdraw no longer applies to your licence to that template under Article 16(m) of EU Directive 2011/83/EU on Consumer Rights. This limitation applies to the licence granted by us; your rights to a refund from Polar under its Buyer Terms are set out separately in Polar's Checkout Buyer Terms.

6. Refunds

All refunds are issued by Polar Software, Inc., our Merchant of Record. Polar may, at its discretion, grant a full or partial refund within ten (10) days of a one-off purchase or within thirty (30) days of a subscription renewal, and may additionally issue refunds up to sixty (60) days after purchase to resolve disputes and chargebacks. Nothing in this policy limits any non-waivable statutory consumer right, including, for EU/EEA and UK consumers, rights under EU Directive 2011/83/EU on Consumer Rights and the UK Consumer Contracts Regulations 2013.

To request a refund, contact Polar at support@polar.sh, reply to your Polar order receipt, or see our Refund Policy for our process, response times, and Polar's role. We cannot issue refunds directly; all refunds are routed through Polar.

7. Intellectual Property & License

When you purchase a template, you receive a personal, non-exclusive, non-transferable license to use the template under the license type shown at checkout (e.g. Personal or Team). You may modify, white-label, and deploy the template for your projects. You may not resell, redistribute, or sublicense the template or its source code as a standalone product.

8. Prohibited Uses

You may not use the Service or any template for any unlawful purpose, to infringe intellectual property rights, or to distribute malware. You may not attempt to gain unauthorized access to our systems, other users' accounts, or the template source code beyond the license granted.

9. Disclaimer of Warranties

Templates are provided "as is" without warranties of any kind. We do not warrant that templates will be error-free or fit for a particular purpose. You are responsible for testing and securing any application you build with our templates.

10. Limitation of Liability

To the maximum extent permitted by law, Boilerlykit and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Service or any template.

To the maximum extent permitted by law, Boilerlykit's total liability for any claim relating to the Service or a purchase is limited to the amount you paid to the Merchant of Record for the template that is the subject of the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Your Responsibility for Your Use

You are solely responsible for how you use the templates and for any application, website, or service you build, deploy, or operate using them. You are responsible for compliance with applicable laws, security best practices, and any third-party terms for services you integrate (e.g. payment providers, databases, analytics).

12. Governing Law & Dispute Resolution

Licence agreement with us. These Terms, covering the licence of the templates, your use of the Service, intellectual property, disclaimers, liability and your responsibilities, are governed by the laws of Algeria, excluding its conflict-of-laws rules. Disputes arising out of or relating to these Terms that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent courts of Algiers, Algeria.

Payment contract with Polar. The separate sales contract between you and Polar Software, Inc. for the purchase of the template is governed by Polar's Checkout Buyer Terms (Delaware, United States law) at https://polar.sh/legal/checkout-buyer-terms. Refunds, chargebacks, billing and tax are determined under that contract, not under these Terms.

Nothing in this section removes or limits mandatory consumer-protection rights that apply to you under the law of your country of habitual residence. Buyers resident in the European Union retain all rights under EU Directive 2011/83/EU on Consumer Rights and may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service or templates after changes constitutes acceptance of the revised Terms.
